CODE OF CONDUCT AND ETHICS

The academic community of the Department of Digital Arts and Cinema operates on the basis of the principles of academic freedom, decency, honesty, consistency and mutual respect. Both the academic staff and the student body ensure the continuous observance of these principles as well as the general demonstration of academic ethics in the exercise of their duties. The Community of the Department of Digital Arts and Cinema considers it a top priority to ensure and maintain a safe educational, academic and working environment for the student body, the teaching and administrative staff.

ARTICLE 1    Code and Ethics Policies of the Department

  • 1.1.  The National and Kapodistrian University of Athens (NKUA), as a Higher Educational Institution aims to produce and transmit knowledge, research, teaching and higher education and to create the necessary conditions for the emergence of new researchers and the promotion of the intellectual, social and mental development of its students. To fulfill the above mission, a system of principles, values, guidelines and standards for the action of the members of the academic community expressed through the Code of Ethics is required.
  • 1.2.  The academic community of the Department of Digital Arts and Cinema complies with the Code of Contact and Ethics of NKUA and operates on the basis of the principles of academic freedom, decency, honesty, consistency and mutual respect.
  • 1.3.  The Code of Conduct and Ethics Policy as defined by the Department apply:
  1.  For the members of the teaching and academic staff of the Department of any type
  2.  for all members of the administrative staff,
  3.  for all students attending the Department's courses (undergraduates, postgraduates, PhDs, exchange students),
  4.  for all employees in the Department,

 

ARTICLE 2    Adherence to the Code and Ethics Policies

  • 2.1. The Department of Digital Arts and Cinema recognizes and adheres to the following policies of the National and Kapodistrian University of Athens:
  1.  Gender Equality Policy
  2.   Privacy and Personal Data Protection Policy
  3.   Policy for people with disabilities
  4.   Academic Ethics - Bioethics Policy as stated on the institution's website
  • 4.2.  All members of the student body of all levels and teaching-administrative-collaborative staff of all categories and levels of the Department of Digital Arts and Cinema, without exception, have the obligation to regulate their behavior and activities in accordance with the principles of the Department's Internal Regulations and NKUA.
  • 4.3 . All members of the student body of all levels and teaching-administrative-collaborative staff of all categories and levels of the Department of Digital Arts and Cinema have the obligation to regulate their behavior and activities in accordance with the principles of the Code of Conduct and  of NKUA.
  • 4.4.  Without exception, all members of the student body of all levels and the teaching-administrative-collaborative staff of all categories and levels of the Department of Digital Arts and Cinema must assist the Ethics Committee in its work.

 

ARTICLE 3 General ethical principles of the Department

  • 3.1.  The academic community of the Department of Digital Arts and Cinema operates on the basis of the principles of academic freedom, decency, honesty, consistency and mutual respect. Both the academic staff and the students ensure the constant observance of these principles as well as the general demonstration of academic ethics in the exercise of their duties.
  • 3.2.  The community of the Department of Digital Arts and Cinema considers it its highest priority to ensure and maintain a safe education, research and work environment for faculty, students and administrative staff, not tolerating any form of violence, discrimination treatment, direct or indirect infringing behavior or harassment.
  • 3.3.  In the above context, the exercise of any form of verbal or physical violence or the threat of such actions between members of the Department's community, or instigated by members of the Department, is prohibited.
  • 3.4.  Any form of unwanted verbal, non-verbal or physical harassment with the purpose or effect of offending the dignity of a person is prohibited, as well as acts of intimidation that contribute to the creation of a hostile, humiliating or aggressive environment.
  • 3.5 . Any form of discriminatory treatment and social exclusion between members of the Department's community, for reasons related to a person's gender, origin, external appearance, sexual orientation, political or religious beliefs or health status, is prohibited.
  • 3.6.  The Department of Digital Arts and Cinema operates in accordance with the institutional policies of the National and Kapodistrian University of Athens and the Office of Gender and Equality and combats discrimination based on gender identity and sexual orientation, recognizing the need to reflect gender equality and promotion policies of interculturality in the community of students, teachers and its partners.
  • 3.7 . The academic staff as well as the students of the Department are responsible for the continuous observance of these principles as well as the general demonstration of academic ethics in the exercise of their duties. In the above context, they have an obligation to:
  1. To ensure in the appropriate manner, so that the level of research and teaching is maintained high.
  2. To respect academic freedom and to promote scientific dialogue, to be inspired by a spirit of cooperation and to contribute to the promotion of collective research.
  3.  Not to directly or indirectly hinder other members of the academic community from exercising their academic freedoms, rights and responsibilities.

 

ARTICLE 4 Student's Academic behavior

  • 4.1.  The students of the Department of Digital Arts and Cinema have an obligation to demonstrate diligence, consistency and responsibility in all their activities related to their student status and their cooperation with all members of the teaching and administrative staff of the university.
  • 4.2.  Students must support their opinions with dignity, without controversy or disparaging characterizations, with prudence and seriousness, in any form of communication, written or oral.
  • 4.3.  Students must refrain from inciting, participating in or supporting acts of violence, including verbal violence.
  • 4.4.  Students must refrain from any act that constitutes gender-based violence and intimidating behavior.
  • 4.5.  Students must not participate in actions that hinder the proper functioning of the Institution's bodies and services, academic freedom in research and teaching, as well as the free expression and circulation of ideas.
  • 4.6.  Students must protect the buildings, premises, facilities and equipment of the Institution, ensure that they are kept clean, avoid any pollution and observe the safety rules, refraining from anything that may cause damage to the buildings , the Foundation's facilities and property.
  • 4.7.  Students must not use the Institution's buildings, premises and facilities for acts that promote hatred, violence or non-inclusive processes.
  • 4.8.  The use of the university premises, open or covered, the facilities, infrastructure and equipment of the Foundation, without the permission of the competent bodies, as well as the use of the premises to serve purposes that are not consistent with the mission of the Foundation, or the facilitation of third parties for the performance of these acts is prohibited.
  • 4.9.  The laboratory infrastructure (computers, logistical infrastructure, furniture and other equipment) must be used by the students exclusively for educational and cultural purposes.

 

ARTICLE 5 Academic consistency

  • 5.1. The members of the teaching staff of the University, in addition to the general obligations arising from the civil service code and the Codes to which they are subject in their professional capacity, must:
  1. To observe the laws of the State and the Regulation of the University.
  2. To observe dignified behavior in the exercise of their duties.
  3. To be impartial and to observe the principles of meritocracy, equality, equal treatment and equal opportunities towards students, younger teachers and in general in every case of judgment in which they proceed either as teachers, or as examiners, or as researchers or as bodies or members of collective bodies of the University or as members of a professors' judgment committee or other committees in which they participate, due to their status as University Professors or as scientists and to justify their judgment
  4. To refrain from any crisis in which they personally or their closely related family members are involved or from which they or the above persons derive financial or other benefit.
  5. To refrain from any act that constitutes exploitation of their position vis-à-vis students and their juniors.
  6. With the exception of the obligation they have to testify before judicial, disciplinary or audit authorities, to observe secrecy and confidentiality, regarding matters that come to their knowledge due to the exercise of their duties.
  7. To refrain from any action in which a conflict of interest arises.
  8. To act on the basis of scientific freedom and independence, the freedom of their conscience and above all with meritocratic criteria.
  9. To show prudence and caution in their presence in the media and in the use of the internet.
  10. To make their knowledge and experience available to students during the educational process, which is their main obligation.
  11. To use their exact title and the name of the Academic Institution in which they serve.
  12. To treat students and colleagues with respect.
  13. Consequently, they observe their teaching obligations and do not assign them to third parties.
  14. To continuously participate in the collective bodies of the University, when and as the law stipulates and to participate in the Committees recommended on a case-by-case basis
  15. Not to present intellectual works of third parties as their own.

 

ARTICLE 6 Academic ethics and code of conduct

  • 6.1. Lecturers must demonstrate academic ethics and appropriate decency towards their students, following the principles of the NKUA Code of Conduct and Ethics and the principles of gender equality. In the above context and in accordance with the Department's Code of Conduct:
  1. It is strictly forbidden for the teacher to use any form of physical violence or micro-assaults towards students and their colleagues.
  2. The use of physical or verbal violence or micro-aggressions based on class, gender, race, religious belief or appearance towards students and their colleagues is strictly prohibited.
  3. Any form of abusive behavior in relation to the physical communication and behavior of the lecturer towards their students is strictly prohibited.
  4. Any form of sexual harassment or non-consensual approach/behavior of the lecturer towards the students is strictly prohibited.
  5. The teacher's micro-harassing behaviors towards the students, such as the use of verbal insinuations and any small or large-scale activity that puts the student in a difficult situation or in an unsafe environment, are strictly prohibited.
  6. Non-consensual, unofficial and outside university hours contact or approach between a teacher and a student via telephone call, telephone or printed or electronic message or via social technological networks for personal or selfish reasons is prohibited.
  7. The non-consensual sending of private personal data between a teacher and a student through technological means of communication or other means of communication is strictly prohibited.
  8. The phenomenon of sexual harassment is considered impermissible, as a form of sexist behavior that injures human dignity and is dealt with strictly by the Senate and the Ethics Committee of the University.

 

ARTICLE 7 Gender equality and combating gender-based violence

  • 7.1. The Department of Digital Arts and Cinema recognizes, respects and applies the principles of equal opportunities and equal treatment of men and women in matters of work and employment in accordance with Law 3896/2010 and based on this prohibits:
  1.  any form of discrimination due to gender, direct or indirect in relation to marital status in particular,
  2.  sexual harassment in the workplace, defining it as a manifestation of "any form[s] of unwanted verbal, non-verbal or physical behavior of a sexual nature, with the purpose or effect of offending the dignity of a person, in particular by creating intimidating, hostile , degrading, humiliating or offensive environment",
  3. any less favorable treatment of a person linked to gender reassignment,
  4. the order that discriminates against a person on the basis of sex and
  5. the less favorable treatment of women due to pregnancy or maternity, in the cases of presidential decrees: 176/1997 (Government Gazette 150/A), 41/2003 (Government Gazette 44/A) and article 142 of Law 3655/2008 (Government Gazette 58/A) .
  • 7.2. In the above context, the Department of Digital Arts and Cinema, observing the provisions of Law 4604/2019 (Government Gazette 50/A/26.03.2019):
  1. includes the gender dimension in the drafting of its administrative documents (Article 12) by prohibiting the use of wording that conceals or involves gender discrimination,
  2. includes the recording of the gender dimension both in its actions and in its study programs (Article 17) (G.G.D.O.P.I.F, 2019).
  • 7.3 . The Department of Digital Arts and Cinematography complies with the basic principles and policies of the Gender Equality Action Plan of the National and Kapodistrian University of Athens as defined on its website .
  • 7.4. Violation of the points of this article entails, in addition to the other criminal or other sanctions, the applicable disciplinary consequences.

 

ARTICLE 8 Harassment and violence at work

  • 8.1.  The Department of Digital Arts and Cinema recognizes the need to completely avoid harassment, ill-treatment and violence in any of its workplaces, as referred to in the European Framework Agreement on Harassment and Violence at Work, (26/04/2007) and to this end seeks the establishment and observance of relevant principles and a code of ethics, with a scope of application in the daily operation and coexistence of all members of the academic community of the Program.
  • 8.2.  The Department condemns all forms of harassment and violence and affirms its duty to protect employees from them. Specifically, it adopts a zero tolerance policy to:
  1. Any violent behavior in a physical, psychological and/or sexual form,
  2. violent episodes that manifest as isolated incidents or as more systematic patterns of behavior;
  3. aggressive or violent behavior between colleagues, between superiors and subordinates or by third parties such as customers, patients, students, etc.,
  4.  cases of disrespect to more serious actions, including criminal acts requiring the intervention of public authorities.
  • 8.3. The Department adopts a zero-tolerance policy for such behaviors and, in collaboration with NKUA, adopts procedures to deal with incidents of harassment and violence, when they occur. Complaints are investigated and dealt with promptly and the principles of dignity, confidentiality, impartiality and fair treatment are adhered to.

 

ARTICLE 9 EKPA ethics committee

  • 9.1.  At the National and Kapodistrian University of Athens, the Ethics Committee of the University has been established and operates based on law, which is responsible for monitoring compliance with the rules of academic ethics.
  • 9.2.  The Ethics Committee of NKUA is tasked with ensuring the observance and application of the Rules of Ethics by all members of the academic community. The Committee is responsible for establishing the violation of the rules of ethics and for drawing up a general annual report regarding the observance and application or the need to revise these rules. The report is submitted to the Rector at the beginning of each academic year.
  • 9.3.  All members of the Department of Digital Arts and Cinema must assist the Ethics Committee in its work.
  • 9.4.  The Ethics Committee deals with cases of violation of academic ethics rules, following a relevant complaint or ex officio. The process is as follows:
  1. For each case, the president appoints a rapporteur from among the members of the Commission. If there are indications of a violation of the rules of ethics, the president, following a proposal by the rapporteur, sets an explicit day and time for a hearing before the Committee, to which every member of the academic community is invited in relation to which a question of violation of the rules of academic conduct is raised .
  2. The relevant summons shall be notified in writing to the interested party at least twenty (20) days before the hearing and shall briefly state the rule allegedly violated and the relevant facts.
  3. During the hearing procedure, the interested party has the right to be represented or accompanied by a person of his choice and to file a statement before the Commission within a reasonable period granted by the Commission's president.
  4. In the hearing procedure, the initiator of the case and the interested party have the right to invite up to three (3) witnesses for the further investigation of the case and the proof of their claims.
  5. The witnesses are notified to the interested party and to the Commission at least ten (10) days before the hearing, and they are called in writing by the Commission at least five (5) days before it.
  6. After the completion of the hearing procedure, the Commission finds, with reasons, the existence or non-existence of a violation of the rules of ethics.
  • 9.5. The Ethics Committee undertakes, at its discretion, to restore the reputation and reputation of any member of the academic community, against whom the procedure of the previous paragraph was initiated, if it was not deemed appropriate to conduct a hearing or if a negative decision of the Committee was finally issued , unless the process was widely publicized and there is a risk of harm to the person concerned or the University.

 

ARTICLE 10 Complaint Review Procedure

  • 10.1. The formal complaint procedures related to the violation of the Code of Ethics of the Department are as follows:
  1.  Students can officially file their complaint online through the Department's complaints/objections and complaints procedure - which is described in the Department's Internal Regulations
  2. Students can communicate their complaint to the Department Chair by written letter or official personal contact.
  3. Students can communicate their complaint to the Department Chair by written letter or official personal contact through a legal representative.
  • 10.2. In the event that the competent bodies of the Department do not accept an official complaint, they are unable to resolve it according to the appropriate and legally protected procedures.
  • 10.3.  The Department, upon receiving the formal complaint through the complaints/objections/complaints procedure (chapter 4 paragraph 8 in this Regulation) proceeds to manage it in accordance with the complaints regulation as defined in the Department's Complaints Management regulation and informs the President and its Ethics Committee of the NKUA.
  • 10.4.  The NKUA Ethics Committee, in collaboration with the President, manage the complaint and decide the procedure for resolving it.
  • 10.5.  The process of resolving the issue is carried out with a view to protecting the personal data of the complainant and all others involved.

 

ARTICLE 11 Conduct of investigation

  • 11.1.  The Department of Digital Arts and Cinema complies with the basic principles of ethics and bioethics of the EKPA (Sanct decision 20-10-2015-ADA 6NNΩ46ΨZ2N-Ω0Π)
  • 11.2.  The conduct of research in the Department is governed by the principles below. The researchers:
  1. They must follow the applicable legislation, and be informed of the research guidelines.
  2. They are personally responsible for their actions in accordance with applicable law, international declarations on bioethics and human rights.
  3. Informed consent is obtained from all study participants, who retain the right to freely withdraw their consent.
  4. They ensure the protection of personal data.
  5. They must respect the racial, gender, religious, political and cultural particularities of the participants.
  6.  Not to influence themselves or the results of the study by social, political or economic factors.
  7. They must not hide or distort the results of the study.
  8.  They must keep complete records of the progress and results of a program so that audit is possible, while at the same time in any case safeguarding intellectual property rights.
  • 11.3. The researchers, faculty members of the NKUA, who will direct research programs, must take all the necessary and mandatory scientific measures to protect the health of the workers in the programs from accidents or other side effects that may occur under the special conditions of the research.
  1.  They must observe the general and special safety rules of the NKUA, in the research areas.
  2. They are required to adhere to the principles of sound, transparent and efficient financial management.
  3. When entering into a funding agreement, researchers must not accept conditions that compromise their freedom, prestige and the interests of the University in designing, conducting and publishing their research.
  4.  Researchers must mention in each publication the institution they serve with the full Greek and foreign language title of EKPA.
  5.  Researchers as judges must refrain from making decisions in which conflicts of interest or ethical rules arise.
  • 11.4. Relations between researchers should be governed by the following principles:
  1.  Researchers have an obligation of mutual respect for each other.
  2.  Among the researchers, the younger ones must respect and recognize the experience of the older ones, while the more experienced researchers must respect the personality, fairly evaluate the abilities of the younger ones and introduce them to the methodology and ethics of the research, aiming at the progress of the research activity.
  3. When carrying out the research activity, the researchers must take into account and not in any way infringe on the intellectual property rights of third parties, which they must attribute to its creator. 4) Any person who officially or unofficially receives knowledge of the progress or the product of the research before the completion and publication of their results, must observe complete confidentiality and refrain from actions aimed at exploiting the knowledge or the product of the research for himself or other benefit.
  • 11.5. If the result of the research yields financial benefits, the researchers must notify the Foundation in writing and jointly enter into an exploitation contract.

 

ARTICLE 12 Protection of personal data

  • 12.1.  The Department of Digital Arts and Cinema with respect to personal data complies with the General Data Protection Regulation (EU) 2016/679 in the context of its activity and purpose and takes the prescribed technical and organizational measures for the effective protection of personal data.
  • 12.2.  The personal data that the Department collects and processes are only those that are necessary for the specific and clearly defined purpose and the specific legal basis.
  • 12.3.  In this context, the processing that takes place concerns the personal data that students provide to the Department when they use the Department's official websites and services.
  • 12.4.  The administrative and teaching staff of the Department have access to personal data, in the context of the performance of the tasks assigned to them by the University of Athens.
  • 12.5.  The Department of Digital Arts and Cinema is obliged or entitled to share the personal data of its students with various third party recipients such as:
  1. public bodies,
  2. independent authorities, subject to compliance in any case with confidentiality and the duty of confidentiality and confidentiality.
  • 12.6.  The Department of Digital Arts and Cinema retains the personal data of students for a period of time determined by the applicable legal and regulatory framework.
